OVERVIEW

Welcome to Habit Game.

These Terms of Service (“Terms”) govern your access to and use of the Habit Game website, checkout, digital services, and HabitGame Planner, a Telegram Mini App for daily planning, habits, progress tracking, money tracking, health tracking, and personal productivity.

The terms “Habit Game,” “we,” “us,” and “our” refer to the operator of this website and the provider of HabitGame Planner.

By visiting our website, purchasing a subscription, accessing the Telegram Mini App, or using any related services, you agree to these Terms and our Privacy Policy.

If you do not agree to these Terms, you should not use our website, checkout, Telegram Mini App, or related services.

SECTION 1 — ELIGIBILITY AND ACCOUNT ACCESS

By using our services, you represent that you are at least the age of majority in your jurisdiction, or that you have permission from a parent or legal guardian to use the services.

To purchase or access HabitGame Planner, you may need to provide certain information, including your email address, payment details, billing details, and Telegram account information.

You agree that all information you provide is accurate, current, and complete.

You are responsible for maintaining access to your Telegram account, email account, and any other accounts used to access HabitGame Planner.

You may not transfer, sell, share, rent, or assign your subscription or access rights to another person without our permission.

SECTION 2 — OUR PRODUCT

HabitGame Planner is a digital subscription product delivered through a Telegram Mini App.

The product is designed to help users plan their day, track habits, organize tasks, review progress, track money-related entries, track health-related routines, and build consistency.

HabitGame Planner is not a physical product. No physical items are shipped.

We may update, modify, improve, remove, or change product features at any time.

We make reasonable efforts to describe our product accurately, but we do not guarantee that every feature, screenshot, image, description, or promotional material will exactly match your individual experience.

SECTION 3 — SUBSCRIPTION TERMS

HabitGame Planner may be offered as a paid subscription.

The current offer may include an introductory period of $1 for 7 days, followed by a recurring subscription of $29 per month unless canceled before renewal.

The exact subscription price, intro offer, billing period, renewal terms, and cancellation terms will be shown at checkout.

By completing checkout, you authorize recurring charges according to the subscription terms shown at checkout.

If your subscription renews, the payment method you provided may be charged automatically unless you cancel before the renewal date.

You are responsible for reviewing the subscription terms before completing purchase.

SECTION 4 — BILLING AND PAYMENT

Payments may be processed through Shopify and its payment providers.

You agree to provide current, complete, and accurate payment and billing information.

You represent that you are authorized to use the payment method provided.

Prices, promotions, discounts, and subscription terms may change from time to time. Any changes will apply as described at checkout or in accordance with applicable law.

If a payment fails, we may suspend or limit access to HabitGame Planner until payment is successfully completed.

SECTION 5 — CANCELLATION

You may cancel your subscription at any time.

Canceling your subscription stops future renewal charges. It does not automatically refund payments that have already been processed.

If you do not want your subscription to renew, you must cancel before the next billing date.

SECTION 6 — REFUNDS

Because HabitGame Planner is a digital access product, payments are generally non-refundable once access has been provided.

Refund requests may be reviewed in cases such as:

- duplicate payment;
- billing error;
- payment processed but access was not provided;
- technical access issue that our support team cannot reasonably resolve.

Refunds are handled according to our Refund Policy and applicable law.

SECTION 7 — DELIVERY AND ACCESS

HabitGame Planner is delivered digitally.

After purchase, access may be provided through the website, email instructions, Telegram, or another access flow connected to your purchase.

You may need to use Telegram to access the Mini App.

If you purchase but cannot access the product, contact us at:

There are no shipping fees, shipping carriers, tracking numbers, customs fees, or physical delivery requirements.

SECTION 8 — TELEGRAM MINI APP ACCESS

HabitGame Planner operates through Telegram.

Your use of Telegram is also subject to Telegram’s own terms, policies, and technical availability.

We are not responsible for interruptions, restrictions, account issues, outages, or platform changes caused by Telegram.

If your Telegram account is unavailable, restricted, deleted, or inaccessible, your ability to use HabitGame Planner may be affected.

SECTION 9 — USER CONTENT AND DATA

HabitGame Planner may allow you to create, store, and manage personal productivity content, including tasks, habits, plans, projects, reviews, money entries, health entries, notes, routines, and other information.

You are responsible for the content you enter into the product.

You agree not to enter unlawful, harmful, abusive, fraudulent, or infringing content.

You retain ownership of the content you create. You grant us the limited right to process, store, display, and use that content as necessary to provide and improve the product.

SECTION 10 — MONEY AND HEALTH TRACKING

HabitGame Planner may include money tracking, health tracking, habit tracking, routine tracking, sleep tracking, workout tracking, water tracking, energy tracking, or similar personal tracking features.

These features are provided for personal organization and productivity purposes only.

HabitGame Planner does not provide medical, financial, legal, investment, tax, accounting, or professional advice.

You are responsible for your own decisions, actions, health choices, financial choices, and personal routines.

SECTION 11 — PRODUCT AVAILABILITY

We aim to keep HabitGame Planner available and working reliably.

However, we do not guarantee that the website, checkout, Telegram Mini App, backend systems, or related services will always be uninterrupted, error-free, secure, or available.

Access may be affected by maintenance, updates, outages, Telegram platform issues, payment provider issues, internet issues, third-party service issues, or events outside our control.

SECTION 12 — ACCEPTABLE USE

You agree not to misuse the website, checkout, Telegram Mini App, or related services.

You may not:

- use the services for unlawful, fraudulent, harmful, or abusive purposes;
- attempt to bypass payment, subscription access, entitlement checks, or paywall restrictions;
- interfere with or disrupt the services;
- reverse engineer, copy, scrape, or extract the product or its content;
- use bots, automation, or scripts to abuse the services;
- attempt to gain unauthorized access to systems, accounts, databases, or user data;
- upload or transmit malware, viruses, or harmful code;
- impersonate another person;
- violate intellectual property rights;
- resell, sublicense, or redistribute access to HabitGame Planner;
- use the services in a way that harms Habit Game, Shopify, Telegram, other users, or third parties.

We may suspend, restrict, or terminate access if we believe you have violated these Terms.

SECTION 13 — INTELLECTUAL PROPERTY

The website, product, Mini App, brand, design, interface, graphics, text, copy, images, logos, workflows, software, content, and related materials are owned by Habit Game or its licensors.

These Terms do not grant you ownership of any intellectual property.

You may use HabitGame Planner for your personal use while your access is active.

You may not copy, reproduce, distribute, modify, sell, resell, publish, create derivative works from, or commercially exploit any part of the product or website without our prior written permission.

The Habit Game name, logo, product names, designs, and slogans are trademarks or brand assets of Habit Game.

SECTION 14 — THIRD-PARTY SERVICES

Our services may rely on third-party platforms and providers, including Shopify, payment providers, Telegram, hosting providers, analytics tools, support tools, and infrastructure providers.

We are not responsible for third-party services that we do not control.

Your use of third-party services may be subject to their own terms and policies.

SECTION 15 — RELATIONSHIP WITH SHOPIFY

Our website and checkout may be powered by Shopify.

Shopify enables us to provide website, checkout, payment, and commerce functionality.

Any purchase you make through our store is made directly with Habit Game, not Shopify.

By using our website and checkout, you acknowledge that Shopify is not responsible for any aspect of your purchase, product access, subscription, support, refund request, or use of HabitGame Planner, except as required by Shopify’s own terms or applicable law.

SECTION 16 — PRIVACY

By using our services, you acknowledge that you have read and understood our Privacy Policy.

SECTION 17 — FEEDBACK

If you send us ideas, suggestions, reviews, comments, feature requests, testimonials, or other feedback, you grant us the right to use that feedback to improve, market, and operate HabitGame Planner.

We may use feedback without compensation, restriction, or obligation to you.

You agree that your feedback will not violate the rights of any third party.

SECTION 18 — REVIEWS AND TESTIMONIALS

If you submit a review, testimonial, rating, or public comment, you give us permission to display, reproduce, edit for clarity, and use it in marketing materials, website content, social media, ads, product pages, or other promotional materials.

We may remove reviews or testimonials that we believe are false, misleading, abusive, unlawful, or inappropriate.

SECTION 19 — ERRORS, INACCURACIES, AND OMISSIONS

There may occasionally be errors, inaccuracies, or omissions on our website, checkout, product pages, emails, or promotional materials.

These may relate to product descriptions, pricing, promotions, subscription terms, availability, or other information.

We reserve the right to correct errors, update information, cancel orders, or modify content at any time, including after an order has been submitted, where permitted by law.

We may suspend, restrict, or terminate your access to the services if:

- you violate these Terms;
- your payment fails;
- your subscription expires or is canceled;
- you misuse the product;
- we detect fraud, abuse, or unauthorized access;
- we discontinue the service or part of the service;
- we are required to do so by law.

You remain responsible for any amounts owed up to the date of termination.

Sections related to intellectual property, user content, payment obligations, disclaimers, limitation of liability, indemnification, privacy, and other provisions that should reasonably survive termination will continue to apply.

SECTION 21 — DISCLAIMER OF WARRANTIES

HabitGame Planner and all related services are provided “as is” and “as available.”

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and uninterrupted operation.

We do not guarantee that the product will meet your expectations, create any specific result, improve your habits, improve your finances, improve your health, or produce any guaranteed outcome.

Your use of the product is at your own discretion and risk.

SECTION 22 — LIMITATION OF LIABILITY

To the fullest extent permitted by law, Habit Game, its owners, employees, contractors, partners, service providers, licensors, and affiliates will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages.

This includes, without limitation, loss of profits, loss of revenue, loss of data, loss of access, business interruption, personal decisions, productivity outcomes, financial outcomes, health outcomes, or damages arising from your use of or inability to use the services.

To the fullest extent permitted by law, our total liability for any claim related to the services will not exceed the amount you paid to Habit Game for the service during the three months before the claim arose.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

SECTION 23 — INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Habit Game, Shopify, Telegram, and our affiliates, owners, employees, contractors, partners, service providers, and licensors from any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from:

- your use of the services;
- your violation of these Terms;
- your violation of any law;
- your violation of third-party rights;
- your user content;
- your misuse of the product;
- your attempt to bypass access, payment, or security systems.

SECTION 24 — CHANGES TO THE PRODUCT

We may modify, update, improve, replace, suspend, or discontinue any part of the product or services at any time.

We may add or remove features, change layouts, update pricing, modify access rules, or change the subscription structure where permitted by law.

If changes materially affect your subscription, we will provide notice where required.

SECTION 25 — CHANGES TO THESE TERMS

We may update these Terms from time to time.

When we update these Terms, we will revise the “Last updated” date.

Your continued use of the website, checkout, Telegram Mini App, or related services after changes are posted means you accept the updated Terms.

SECTION 26 — GOVERNING LAW

These Terms and any disputes related to these Terms or the services will be governed by the laws applicable in the jurisdiction where Habit Game operates, without regard to conflict of law principles.

Where required by applicable law, you may also have rights in your local jurisdiction.

SECTION 27 — SEVERABILITY

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the remaining provisions will remain in effect.

SECTION 28 — WAIVER

Our failure to enforce any provision of these Terms does not waive our right to enforce that provision later.

SECTION 29 — ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Refund Policy, and any subscription terms shown at checkout, constitute the entire agreement between you and Habit Game regarding your use of the services.
